Terms of Service

1. Acceptance of Terms

By accessing or using the MiCarePal platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MiCarePal is a workspace platform for childcare and elder care providers to manage their care business. We provide tools for scheduling visits, maintaining care profiles, messaging families, and sending invoices. MiCarePal does not employ care providers, nor do we directly provide care services. Care providers are independent contractors who set their own prices, schedules, and service terms.

3. Eligibility

You must be at least 18 years old to create an account and use MiCarePal. By registering, you represent that you are of legal age and have the capacity to enter into a binding agreement.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate, current, and complete information during registration
• Update your information to keep it accurate and current
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with any third party

5. Care Provider Terms

Care providers using MiCarePal agree that:

• They are independent contractors, not employees of MiCarePal
• They are solely responsible for the quality and safety of their care services
• They will comply with all applicable local, state, and federal laws
• They will maintain any required licenses, permits, or insurance for their services
• They will accurately represent their experience, qualifications, and services
• They will maintain the confidentiality of sensitive family and care recipient information

6. Family / Client Terms

Families and clients using MiCarePal agree that:

• They are responsible for providing accurate information about care recipients, including health conditions, allergies, medications, and special needs
• They are responsible for selecting and vetting their care providers
• MiCarePal is not liable for any injury, loss, or damage related to care services
• They will respect the privacy and confidentiality of care providers

7. Payments & Fees

MiCarePal facilitates payments between families and care providers. Platform fees vary by subscription tier and are disclosed during onboarding. Payment processing is handled by third-party providers (Stripe), and their terms of service also apply.

8. Subscriptions

Care providers may subscribe to paid plans for enhanced features. Subscriptions auto-renew unless cancelled before the end of the billing period. Refunds are handled in accordance with applicable law and our refund policy. You may cancel your subscription at any time through the app settings.

9. User Content

You retain ownership of content you submit (photos, care notes, profile information). By posting content on MiCarePal, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content in connection with the Service. You agree not to post content that is illegal, defamatory, harassing, or infringes on the rights of others. You must not share protected health information (PHI) in ways that violate HIPAA or other applicable privacy laws.

10. Prohibited Conduct

You may not:

• Use the Service for any unlawful purpose
• Impersonate any person or entity
• Post false or misleading information
• Harass, abuse, or harm other users
• Attempt to circumvent platform fees or payment systems
• Scrape, data mine, or use automated systems to access the Service
• Interfere with the security or integrity of the Service
• Share care recipient information outside the platform without consent

11. Limitation of Liability

MiCarePal is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to injury to persons, property damage, or loss of income. The Service is provided "as is" without warranties of any kind. We do not guarantee the quality, safety, or legality of services provided by care providers.

12. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason at our sole discretion. You may delete your account at any time through your account settings.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
